Empirical Analysis of Doctors¡¯ Criminal Responsibility and Its Implications

Abstract

|
In this study, the trend of medical liability cases, especially cases of criminal liability of doctors for occupational negligence, is explained through case analysis from 2000 to 2020, and the statistics of innocence and innocence by year of medical personnel and the status of criminal punishment by doctors are analysed.
Among the total number of criminal judgments of doctors (295), the number of medical malpractice cases (207 cases of negligence by doctors) and the number of guilty/not guilty cases (198 cases/97 cases) The analysis was performed by doctor, type of medical accident, physician/hospital, specialty area, injury/death type, victim type, fine/incarceration sentence, acquittal rate, and revocation rate in appeals (guilty to acquittal/innocence to guilty rate). Although data on domestic precedents are limited during data collection and Excel work, the correlation between statistical values ??and social impact is indirectly examined. Each specialized field is classified by type. These are showed the policy implications and future prospects.
